TERMS AND CONDITIONS OF USE OF THE ONLINE STORE

In this document, the term "Customers" refers to visitors to the site over 18 years of age, whether they are buyers or potential buyers. Purchases, payments and transactions made by customers through BIRM's virtual store, on the page https://www.birm.com.ec, hereinafter "the site", shall be subject to these terms and conditions, therefore, they accept the express conditions detailed in the following document

USE OF BIRM'S ONLINE STORE SERVICES

BIRM's services are only available in Ecuador. When accessing BIRM's website, in order to make purchases, the user must register and declare to be over 18 years of age and be empowered to assume binding obligations with respect to any type of liability arising from the use of BIRM's services. The acts that minors perform on the BIRM website will be the responsibility of their parents, guardians or caregivers.

INTELLECTUAL PROPERTY

All intellectual property rights of BIRM website, its contents and designs belong to BIRM or, where appropriate, to related companies and/or third parties. In those cases, in which they are owned by third parties, BIRM has the necessary licenses or permissions for their use.
The reproduction, distribution, transformation, public communication, making available or any form of use of all or part of the contents of the BIRM website, in any medium and by any technical means, without the authorization of BIRM, is expressly prohibited. The User undertakes to respect the intellectual property rights owned by BIRM, related companies and third parties.
Likewise, the use or reproduction of any trademark, name or logo appearing on the BIRM website is expressly prohibited without the prior written authorization of MAXIDUCTS.
Finally, the following practices, by way of example, are also prohibited:
The presentation of a page of BIRM services in a window that does not belong to BIRM, using the technique known as "framing".
The insertion of an image published on the BIRM website on a page not belonging to MAXIDUCTS, by means of the technique known as "in line linking".

MEANS OF PAYMENT

Users have the following option to pay for their orders:

Cards issued by national and international banks will be accepted. No closed cards (those without the MasterCard, Visa or American Express logo) will be accepted. After the User has confirmed the order, he/she is responsible for having the payment method indicated during the purchase process. If the User does not have the means of payment, the order will not be processed and will be cancelled.
The products offered on the BIRM website, unless a different form is indicated for particular cases or offers of certain goods or services, can only be paid with the means specifically indicated in each case. The use of credit or debit cards shall be subject to the provisions of these Terms and Conditions and, in relation to their issuer, and to the provisions of the respective contracts signed with the bank issuing the means of payment.
In case of contradiction, the latter instrument shall prevail. In the case of bank cards accepted in BIRM's website, the aspects related to them, such as the date of issue, expiration, blocking, commission charges, purchase interest, etc., shall be governed by the respective contracts signed with the bank issuing the means of payment, in such a way that BIRM shall not be liable for any of the aforementioned aspects.
Upon any suspicion and/or confirmation of unauthorized purchases BIRM will cancel the purchase and void the transaction.
The user must sign one of the sales vouchers that the courier will give him/her, which will serve as support for the delivery of the products.

RETURNS AND EXCHANGES

The first option for the refund of a payment will be a credit note, in case the customer does not agree, the purchase will be refunded through the same payment method.
The maximum term to proceed with a claim will be 3 days after the date of purchase art. 45 and 71 of the "Ley Orgánica de Defensa del Consumidor".
To initiate the process, the customer must send the request to ventasymarketing@brmetics.com.ec indicating in the claim:
Contact information: Full name and cell phone number.
Photo of the purchase invoice.
Copy of citizenship card, Bank account number, credit card or payment to which the transaction was charged.
Express statement of the reasons for the request.
The customer will be contacted by our Customer Service area to coordinate the delivery of the product. The customer must deliver the product in the same conditions in which it was delivered or as agreed with MAXIDUCTS.
In case of reverse payment for bad shipments attributable to the internal process will be coordinated the withdrawal of and / or products in the same place, conditions in which it was delivered.

TERMS AND CONDITIONS FOR RETURNS AND EXCHANGES

The only reasons for which exchanges or refunds will be accepted are the following:
The product is in poor condition or has packaging defects.
Poor delivery of the order.
The products do not correspond to what was requested by the customer.

RESPONSIBILITY OF THE CUSTOMER

Please take into account the terms and conditions described in this site, before purchasing any of the available products.
Check before finalizing the purchase, so that the products included in the shopping cart correspond in quantity, presentation and concentration of the active ingredient required.
Provide the correct information for shipping and billing purposes, so that you do not incur costs for redirecting the order.
Read and follow carefully the instructions for conservation and storage of the products.
Always keep the purchase invoice.

TERMS AND CONDITIONS OF SHIPMENT

Coverage and rates:
BIRM services are only available in Ecuador.
The cost of shipping will maintain a standard rate of $3.00 + Taxes.

Delivery times:

The established delivery time for orders is 48 hours within the coverage area and 72 hours for special routes. The delivery time of the order will begin to count from the moment in which the user's data is analyzed and payment is confirmed.

ORDER TRACKING

In the event that the order is not received within the timeframe offered, the user may contact (+593) 2 2992910 to verify the status of the order.

DELIVERY OF THE ORDER

The order must be delivered to the person who generates the purchase at the place registered as shipping address, for which the signature of the courier's waybill will be required as confirmation of receipt of the order.

In exceptional cases for delivery to third parties, the name of the person who is to receive must be entered in the store remark.

DELIVERY POLICIES

The delivery times of our products are: 24 hours to main cities, 48 hours to secondary cities and 72 hours to special routes.  There are special cases, in cities with a low level of shipments, in which the delivery time may exceed 72 hours.  In these cases, our Customer Service staff will contact the buyer to notify the delivery time. Delivery time is counted in working days.
All orders placed after 12:00 noon, on Thursday until 24:00 midnight, on Sunday will be delivered the following Monday, according to the delivery time corresponding to the shipment.
We do not ship on weekends and holidays.
